Modification of Court Orders

As a divorce decree modification attorney and order modification lawyer in Austin, Texas, I know there is often confusion regarding these issues in Texas divorce and other family law cases. Divorced people often seek post-decree modifications to adjust the amounts they are required to pay for child support or spousal maintenance or to readjust child custody agreements. Reasons for post-decree modifications may include any major change in either person’s situation, including:

  • decrease in income of the payor spouse, perhaps due to loss of a job
  • increase in income of either spouse
  • remarriage of the spouse who receives spousal support or child support
  • adoption of a child by a step-parent.

Is it Worth It to Pursue a Post-Divorce Modification?

Contact us to request a modification lawyer consultation if you are in need of a change in your divorce decree for any reason. At your initial attoreny consultation, we will help you determine whether your desired post-decree modification is cost effective. In other words, will it cost more to obtain it than what you will save?

Modifications through Mediation

If together we determine that your post-divorce modification is worth pursuing, we can advise you regarding how you and your ex-spouse may be able to use mediation to achieve your goals, rather than arguing the case in court. We can help communicate to your ex-spouse the benefits of such an approach. If mediation is an option in your case, any money saved on court costs and attorney’s fees will be available for the family to use for other goals. Of course, if negotiations fail, we can take the case to court for the judge to decide.

In mediation, couples are able to consider what is most important to them in a private and dignified setting, without the interference of a judge or jury. Mediation is almost always less stressful and less expensive than court proceedings. Furthermore, when children are involved, mediation can set the tone for a reasonable means of communication that will be important as the parents, though divorced, continue to cooperate in child rearing through the years until their children become adults. Often with the help of their family law attorneys, clients can resolve their case in mediation without the trauma, expense and emotional strain of fighting in court.
